Minutes:

The Licensing Authority receive an application to vary the existing premises licence to permit the Sale by Retail of Alcohol for consumption off the premises from 06:00am until 23:00 every day at the premises at 90-100 Brighton Road, KT6 5PP.

 

The Licensing officer introduced the application and confirmed that in accordance with the Council’s Statement of Licensing Policy, 224 residents were consulted in writing and informed that an application had been received.  Subsequently two representations were received opposing the granting of the licence.

 

The Licensing Officer informed the Sub Committee that the application was a variation on the current licence which was for Sale by Retail between the hours of 8:00 to 23:00 Monday to Saturday and Sunday from 10:00 to 22.30.

Having considered the application for a variation of a Premises Licence under the Licensing Act 2003, and having considered the written representations and oral representations of the objectors and the written and oral representations on behalf of the Applicant, and having regard to the Secretary of State’s Guidance, the Council’s Licensing Policy and the licensing objectives, in particular, ensuring that the Prevention of Crime and Disorder, the Prevention of Public Nuisance and the Protection of Children from Harm licensing objectives are met the Sub-Committee RESOLVED to grant the application subject to the following conditions as agreed with the Metropolitan Police, in addition to those set conditions offered by the Applicant in the operating schedule at boxes M c), d) and e):

 

1.     A CCTV system will be installed, or the existing system maintained, such system to be fit for the purpose and be to the reasonable satisfaction of the Police;

 

2.    Any recording shall be retained and stored in a suitable and secure manner for a minimum of 31 days and shall be made available, subject to compliance with Data Protection legislation, to the Police or Council Official for inspection within 24 hours of each request;

 

3.    A written delegation of authority record will be kept at the premises whereby non personal licence holders are authorised to make sales on behalf of a personal licence holder;

 

4.    All staff engaged or to be engaged in the sale of alcohol on the premises shall receive the following training in age restricted sales:

 

o   Induction training which must be completed and documented prior to the sale of alcohol by the staff member;

 

o   Refresher/reinforcement training at intervals of no more than 6 months;

 

o   Training records will be available for inspection by a Police Officer or an authorised Officer of the Council upon request;

 

5.    No alcohol products (excluding the products behind the counter) will be displayed for sale within three metres of the entrance/exit of the store; and

 

6.    All alcohol products containing 30% ABV or more to be kept behind the counter.

Ravens Ait - Ravens Ait Island, Portsmouth Road, Kingston upon Thames, KT6 4HN pdf icon PDF 4 MB

Minutes:

The Licensing Authority receive an application for the variation of the existing premises licence to extend the licensable area to the whole island, including the marquee and to permit the Provision of Late Night Refreshment (Indoors) from 23:00 until Midnight every day at the premises at Ravens Ait, Portsmouth Road,  KT6 4HN.

 

The Licensing Officer introduced the application and confirmed that in accordance with the Council’s Statement of Licensing Policy, 357 residents were consulted in writing and informed that an application had been received.  Subsequently 22 representations were received opposing the granting of the licence.

 

The Licensing Officer informed the Sub Committee that the current licence was reviewed by the Licensing Sub Committee on 26 November 2013 as noise and disturbance had been identified as an issue and conditions to remedy this were confirmed by the Sub Committee at that meeting.

 

The Licensing Officer advised that planning and licensing applications were entirely separate and approval of one application did not imply approval of the other.  The Licensing Officer also advised that agreement had been reached between the applicant and the Metropolitan Police on three conditions and the Police had withdrawn their objection relating to the likely increase of Crime and Disorder and Public Nuisance.  The proposed conditions were circulated.

Having considered the written representations, heard the oral representations on behalf of the Applicant, Metropolitan Police and other persons and having regard to the Secretary of State’s Guidance, the Council’s Licensing Policy and the licensing objectives, in particular, ensuring that the Prevention of Crime and Disorder, Public Safety and the Prevention of Public Nuisance licensing objectives are met the Sub-Committee RESOLVED to grant the application with the following conditions: (conditions 1-3 having been agreed between the Police and the Applicant):

 

  1. When licensable activity is taking place the premises will have immediately available, for police, a boat capable of carrying a minimum of 6 passengers.

 

  1. When licensable activity is taking place then, subject to condition 3, SIA door staff will be deployed on Raven’s Ait, solely in that role, at a ratio of a minimum of one SIA door staff for every 75 patrons.

 

  1. The numbers of door staff may, subject to a risk assessment, be reduced by the licence holder where:

 

a)     the number of patrons is less than 100;

 

b)     no alcohol is being consumed at the event;

 

c)     it is a corporate event, wedding ceremony, wedding reception silver wedding anniversary event, golden wedding anniversary event or diamond wedding anniversary event;
