To consider the grant of a short-term lease to Chapel Street Community Schools Trust to enable them to use the ground floor of Murray House as temporary accommodation for Kingston Community School.

Decision:

RESOLVED that –

 

1)    a short-term lease at Market Value for the use of the Murray House site (as shown on the red line plan at Annex 1 to the agenda report) by Kingston Community School between the period from 1st February 2019 to 31 August 2020 be granted to Chapel Street Community Schools Trust, on the understanding that the site be returned to the Council for other use at the expiry of the lease; and

 

2)    the waiver of Call-In provisions be considered in accordance with Paragraph 2(A) of the Community Call-In Procedure Rules on the grounds of urgency in view of the serious detriment that the Council would suffer if a decision were to be delayed.

 

 

Minutes:

The Committee gave consideration to the grant of a short term lease of the ground floor of Murray House in Acre Road to Chapel Street Community Schools Trust.

 

Members noted that the Trust sought the use of the former residential care home site to provide temporary accommodation for Kingston Community School, a primary free school, pending the expected completion of the school’s permanent accommodation in Coombe Road, Norbiton in September 2020. The scheme had been delayed due to difficulties experienced by the Education and Skills Funding Agency in procuring a developer and the school’s pupil roll would exceed the physical capacity at its current location by September 2019, thereby requiring it to operate a split site arrangement for the 2019/20 academic year.  The Department for Education’s property company, LocatEd, had identified Murray House as the only potential site – either Council or privately owned – within close proximity of the school’s current site.

 

No assessment of options regarding the long term use of the recently vacated Murray House had yet been undertaken. After hearing from the Chair of the Chapel Street Trust it was therefore agreed that a lease should be granted to it for the period from 1 February 2019 to 31 August 2020 at a market rent, details of which were contained in exempt papers noted by Members but not directly referred to during the course of the meeting. In the event of the school having to stay beyond the 2019/20 academic year due to over-run in the construction of its permanent development, LocatEd might potentially be contractually required to pay a monthly penalty charge to the Council.

 

The Committee noted that LocatEd had provided a written assurance that it had never invoked, and in this case would not invoke, the Secretary of State’s power to use the site for Kingston Community School or another academy school’s use once the lease had expired and at that time the site would once again be available for the Council’s own purposes. A report would be submitted to the Committee on the long term use of the Murray House site prior to the expiry of the short term lease.

 

In view of the need for urgent implementation of the Committee’s decision Members endorsed the view that the call-in provisions in respect of this matter should be waived. The final decision on the grant of a waiver would rest with the Chief Executive in consultation with the Chairs of this Committee and the Scrutiny Panel.

 

RESOLVED that –
