The Licensing Officer introduced the matter for determination and informed the Licensing Sub-Committee that the application sought the grant of the following:

Licensable Activities

Sale by retail of alcohol (for consumption on and off the premises),

12:00 - 21:00 Monday to Sunday

Opening Hours

06:30 - 21:15 Monday to Sunday

The application initially sought to authorise the sale by retail of alcohol (for consumption on and off the premises), from 12:00 hours to 23:00 hours Monday to Sunday.

Following discussions with Responsible Authorities, the applicant amended its application and sought to provide the hours authorised.

The Licensing Officer confirmed that the applicant had advertised the application, as required, by way of a statutory poster at the premises and by advertisement in a local newspaper, and that the application had also been advertised on the Council’s website for the full consultation period. In addition, 140 addresses were consulted in writing and informed that an application had been received. 4 valid representations were received from Other Persons. The representations made reference to matters that related to all four licensing objectives.

The Licensing Sub-Committee invited the Applicant’s representative to present their application, who reiterated that the licensable hours to serve alcohol on and off the premises had been reduced from 12:00 to 23:00 to 12:00 to 21:00 after consultation with local Police. The applicant was aware of concerns that the premises would eventually turn into a bar and stressed that they do not ever envisage changing from being primarily a coffee shop aimed at commuters entering and exiting Malden Manor train station, as well as the local community. The applicant explained that no glassware would be allowed to leave the premises at any time and that signage would be displayed to reflect this policy as well as sufficient staff training would be provided on the matter. Extensive CCTV would be in place to record and report any public nuisance or crime and disorder at the premises or immediately outside. Furthermore, the garden area would be cleared at around 20:30 - 20.45 to reduce the risk of any noise or public nuisance to local residents. The overall aim of the Premises Licence application was to provide greater flexibility for serving customers.

The applicant did not feel that those who typically visit the premises are the type that are likely to cause any such nuisance if they were to consume some alcohol.

The Licensing Sub-Committee queried what assurances the applicant could offer to reduce the risk of public nuisance through any music coming from the premises as well as ensuring that there would be no litter outside the premises. The applicant explained that, although regulated entertainment was not included in the application, the music being played from inside the premises would be purely of a background nature (and so it requires no licence) and would be very unlikely even to be audible to local residents.
